Beginning in April 2010, firms working in pre-1978 homes will need to be certified. Along with firm certification, an employee will also need to be certified as a Certified Renovator. Below is an explanation of the difference between a Certified Firm and Certified Renovator.

Certified Firm

All remodeling firms doing work in pre-1978 homes are required to have Firm Certification, which is different from Certified Renovator. There are certain activities in pre-1978 houses that are not subjected to the rule and it is important to look at the rule for a better understanding of exempt activities. Firms are required to be certified by April 22, 2010

Firms may begin applying for certification beginning October 22, 2009. To obtain a copy of the “Application for Firms” contact the NLIC at 1-800-424-LEAD (5323) or visit www.epa.gov/lead/pubs/renovation.htm. The cost for firm certification is $300 and renewable every five years.

Responsibilities of Certified Firm

Certified firms must ensure that:

1. All individuals performing activities that disturb painted surfaces on behalf of the firm are either certified renovators or have been trained by a certified renovator.
2. A certified renovator is assigned to each renovation and performs all of the certified renovator responsibilities.
3. All renovations performed by the firm are performed in accordance with the work practice standards of the Lead-Based Paint Renovation, Repair, and Painting Program.
4. Pre-renovation education requirements of the Lead-Based Paint Renovation, Repair, and Painting Program are performed.
5. The program’s recordkeeping requirements are met.

Certified Renovator

A certified renovator must successfully complete an eight-hour initial training course, including two hours of hands on training, offered by an accredited training provider. The course completion certificate serves as proof of certification. Renovators are required to be certified by April 22, 2010.

Responsibilities of Certified Renovator

1. When requested by the homeowner, must use a test kit accepted by EPA to determine whether components to be affected by the renovation contain lead-based paint.
2. Must provide on-the-job-training to workers on the work practices they will be using in performing their assigned tasks.
3. Must be physically present at the work site when warning signs are posted, while the work-area containment is being established, and while the work-area cleaning is performed.
4. Must regularly direct work being performed by other individuals to ensure that the work practices are being followed, including maintaining the integrity of the containment barriers and ensuring that dust or debris does not spread beyond the work area.
5. Must be available, either on-site or by telephone, at all times renovations are being conducted.
6. Must perform project cleaning verification.
7. Must have with them at the work site copies of their initial course completion certificate and their most recent refresher course completion certificate.
8. Must prepare required records.

The certified renovator will be responsible for training other employees and overseeing work practices and cleaning. The training curriculum, which is currently under development by the EPA, will be an eight-hour class with two hours of hands-on training. Both the firm and Certified Renovator certifications are valid for five years. A Certified Renovator must take a four-hour refresher course to be recertified.

Application for Firm Certification

The Environmental Protection Agency (EPA) has instituted a series of new requirements for renovation, repair and painting contractors.

On (new date) January 1, 2011, firms working in pre-1978 homes and child-occupied facilities must be certified and use lead-safe work practices during renovations. The penalty for noncompliance is $37,000 per day, per violation and possible jail time.

Common renovation activities like sanding, cutting, and demolition can create hazardous lead dust and chips by disturbing lead-based paint, which can be harmful to adults and children. Under the rule, beginning in April 2010, contractors performing renovation, repair and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978 must be certified and must follow specific work practices to prevent lead contamination.

Contractors and sub-contractors receiving payment for any lead-related renovation must be both a Certified Firm (complete Certified Firm application linked below and send with fee to EPA. Takes 60-90 days for approval) and a Certified Renovator (complete 8-hour training course). Both are valid for a period of 5 years after which re-certification is required.

Role of a Certified Renovator

• Perform lead-safe work as described in the RRP Rule
• Train all non-certified workers in lead-safe practices
• Provide onsite and regular direction for all non-certified workers during setup and cleanup
• Are available by phone when not physically present at the work site during work
• Maintain onsite proof of certification as a certified renovator and training records for all non-certified renovation workers
• Be a certified firm if accepting payment for contract
• If they are a sub, not an employee of the firm, they also must be a certified firm

EPA RRP v1.1 – EPA Lead Based Paint Certification training is available in your area. Starting March 4th, Beck Safety Consulting along with the Home Builders Association will begin holding EPA Lead Training classes (RRP).   Due to the high demand for the training, it is recommended that firms register ASAP for the first available training date.

This course will certify participants for the new Lead Renovation, Repair and Painting (RRP) training requirements. In 2008 the EPA announced new rules which go into effect April 22, that alters the way contractors who renovate or repair housing, childcare facilities or schools built before 1978 will do their work.

In Jacksonville’s older neighborhoods, an old worry – lead paint – is drawing attention from the federal government.

The U.S. Environmental Protection Agency fined the operators of four Jacksonville apartment complexes and a house-management company last year after concluding they violated a law that says property owners must tell tenants about any evidence of lead paint.

The last case was finalized in December.

EPA doesn’t know whether tenants at any of those buildings were ever exposed to decaying paints. But it will send inspectors to as many as 175 rental offices around the Southeast each year to audit lease records for disclosure forms that are supposed to be signed by tenants at any property built before 1978.

“Understand that this is a public health issue,” said Anthony Toney, chief of the lead and children’s health section at EPA’s regional office in Atlanta.

Lead poisoning can hurt a child’s brain development and cause neurological problems that can persist as the child grows up. Adults are less vulnerable but can also be harmed by chronic overexposure at high levels.

There were 11 cases of lead poisoning diagnosed among children under age 6 in Duval County in 2009, the most recent numbers available from the Florida Department of Health. Statewide, there were 190.

Jacksonville is on an EPA checklist because its mix of older housing, many young children and records of childhood lead poisoning have raised flags.

Inspectors say simply telling renters about potential risks in older homes and apartments helps them make informed decisions that can lower childhood exposure.

“The improvement in the protection of human health is what we’re after here,” Toney said.

That isn’t always how it looks to landlords.

“They scare the hell out [of you],” said H. Winship Dowell, a property manager who spent five years talking with EPA about inspection results he said he was told could lead to nearly $100,000 in fines.

He settled in April by agreeing to pay $11,000 for a single violation at a home off St. Augustine Road, without admitting any wrongdoing.

“They put this big, heavy hand of the government on you,” he said. “And they have a big, heavy hand.”

Dowell said he has managed rental homes for 25 years and consistently gives tenants all the information about lead paint the law requires. He said he has never known of any tenant experiencing lead poisoning.

He said he willingly opened his files to an inspector in 2005. He said the inspector seized on minor inconsistencies in paperwork, such as a tenant initialing a form in the wrong spot.

Dowell said he was terrified when told a series of mistakes like that at nine properties could cost him $11,000 apiece, which he said could ruin him.

The maximum fine per infraction now is $37,500.

In some cases, though, fines are modest, and Toney said his office sometimes simply mails warnings for landlords to correct shortcomings.

In 23 cases where EPA collected fines around the Southeast last year, the fines totaled $129,000, said agency spokeswoman Dawn Harris Young.

The three other companies that were fined last year in Jacksonville – one was cited for two apartment complexes – were each fined less than $2,000.

One of those, the Madison Apartment Group, also paid for lead testing that confirmed there was no lead to be found, said Loretta Kelly, general counsel for the parent company to the chain that owns Madison at Savannah Oaks at 6017 Roosevelt Blvd. and Madison at Bay Pointe at 4500 Baymeadows Road. The company was among three that agreed to perform about $33,000 worth of work at their complexes in addition to paying cash, Harris Young said.

The other complexes that settled disclosure cases in Jacksonville last year were Park View Place at 6226 Barnes Road S. and Grand Pointe Apartments at 5800 University Blvd. W., according to EPA records.

If you’re thinking of renovating, beware of these materials and regulations before you build. All of the following have been banned in certain regions of the country, so check your local codes.

A Baltimore landlord has been jailed for failing to comply with repeated orders to fix lead-paint risks in all his rental units. Cephus Murrell was ordered Wednesday by Baltimore City Circuit Court Judge W. Michel Pierson to be held in the detention center until he had either remediated three rental units with lead-based paint in them or relocated the tenants to safer housing.

Murrell, who according to court records lives in Catonsville, has been the subject of repeated enforcement actions over the past several years by the Maryland Department of the Environment accusing him of not taking required actions to reduce the risks of tenant children being poisoned by ingesting dust from lead paint in their rental units.

The state fined him $20,000 in 2007 and signed a consent decree requiring him to fix 52 properties owned by him or C. Murrell Business Consultant Inc. Pierson found Murrell in contempt of court in June for not complying with an amended consent decree, with eight units still not repaired. In October, the judge ordered Murrell to jail, but stayed his incarceration to either clean up the remaining untreated units or move the tenants elsewhere. But state officials said this week that Murrell had yet to present the required certification that he’d dealt with three remaining occupied units.

Under a 1994 state law, landlords with rental units built before 1950, when lead paint was widely used, must register their properties with the state and take steps to reduce the chances of youngsters being poisoned. Ingesting even tiny amounts of lead dust or paint chips can damage young children’s developing brains and nervous systems, causing lasting learning and behavioral problems. Ruth Ann Norton, executive director of the Coalition to End Childhood Lead Poisoning, welcomed the judge’s action, saying Murrell had a long history of noncompliance.

“He has continually thumbed his nose at Maryland’s law to keep kids safe,” Norton said. She also said tough enforcement was needed against repeat violators because while most landlords in the state “do the right thing,” there is a “core of owners that just will not follow the law and do not get into compliance.” Murrell could not be reached for comment, nor could his lawyer. But a woman who identified herself as a tenant or former tenant emailed today that had helped “many, many children and adults” and said that he had “allowed lots of people to move in with out paying security deposits.”

Renovations, repairs create dust that causes most exposures today

Problems with lead paint just won’t go away, even though the material was banned in 1978. New sources prompted recent recalls of lead-painted toys made in China. Old sources have prompted the Environmental Protection Agency to issue new regulations that will dramatically impact renovation work in the 38 million homes with lead paint built before the ban.

The lead paint rule

The lead paint Renovation, Repair and Painting rule, in force since April, says that any contractor working in a home with lead paint who disturbs more than six square feet of painted surface inside or 20 square feet outside must be certified and follow EPA guidelines to prevent lead contamination. That could be a painting contractor, a carpenter removing a wall, even a plumber or electrician who opens up old surfaces to install new pipes or wires. If they don’t comply, fines run into thousands of dollars.

The new rule, which covers homes, schools and child care facilities, also applies to landlords, for instance, if you’re renovating a rental house, and to DIYers in their own homes. The EPA says that even a DIY improvement such as replacing old lead-painted drywall is covered by the rule, though it’s not clear how regulations could be enforced in those circumstances.

Expect costs to rise when you hire contractors to work on an older home. First, to protect themselves, contractors may insist on lead testing before the job starts. Then, if lead paint is detected, they will pass on the costs of training courses for workers, safety equipment, HEPA vacuums that can contain particles of lead dust, plus the extra time and material costs of enclosing and then cleaning the work area.

The driving forces behind the lead rule are continuing health problems caused by lead paint even 30 years after the ban. The EPA says that since 2000 about 1 million children have been damaged to some degree by lead poisoning. The health risks were documented decades ago when studies showed that babies and young children who chewed on lead-painted cribs and window sills sustained damage to their nervous systems and developed severe learning disabilities. But the rule targets renovation work because adults and children alike are exposed to the main culprit today: lead in dust form. It’s produced by scraping or sanding walls, cabinets, doors, windows or trim with lead-base paint. The EPA says it’s the way most people are exposed to lead today.

Identifying lead paint

This is a tricky subject for three reasons. First, the date of construction may be difficult to find and is not always accurate. Your title may list it, as well as records at your local tax assessor and real estate sites such as zillow.com. But they may not agree and probably do not date major renovations and additions.

Second, not all lead paint was removed from store shelves in 1978. And, of course, many homeowners continued to use supplies they had on hand for repairs and improvements.

Third, testing for lead paint can be expensive, inconclusive and incorrect. The EPA suggests hiring certified risk assessors or inspectors to check for possible contamination. That can involve X-ray fluorescence screening that costs about $500, several lab tests at about $85 each, and can total the better part of $1,000. But the EPA also covers DIY swab-test kits that consumers can use to check for lead. And the EPA has finally caught up with their inaccuracy.

Many kits returned high percentages of false positives, indicating lead when there was none, and false negatives, indicating no lead when lead was present. The Consumer Product Safety Commission found that no kit consistently detected lead when the old paint was covered with latex paint, a common situation. Flipping a coin produced the same level of certainty. Currently, the EPA recognizes only two kits that produce no more than 5 percent false negatives. The most widely available is the LeadCheck Instant Lead Check 8-Swab kit, about $25.
